TERMS AND CONDITIONS
1. Acceptance of Quotation
1.1 The quotation is valid for 30 days from the date of issue unless otherwise stated.
1.2 Acceptance of the quotation constitutes acceptance of these Terms and Conditions.
1.3 Any amendments or additional work requested by the Client must be agreed to in writing.
2. Scope of Work
2.1 The Contractor shall perform the work as detailed in the accepted quotation.
2.2 Any work not specifically included in the quotation shall be considered additional work and may result in additional charges.
2.3 Changes to specifications, materials, designs, or finishes after acceptance may affect the project cost and completion date.
3. Payment Terms
3.1 A deposit of 70% is payable before commencement of work.
3.2 Progress payments shall be made according to agreed project milestones.
3.3 The balance is due immediately upon completion of the project.
3.4 Late payments may attract interest at the maximum rate permitted by law.
3.5 The Contractor reserves the right to suspend work if payments are not received as agreed.
4. Materials
4.1 Unless otherwise specified, all materials supplied shall be of standard quality suitable for the intended purpose.
4.2 Material prices are subject to supplier availability and market fluctuations prior to purchase.
4.3 The Contractor reserves the right to substitute materials with equivalent alternatives where necessary, subject to Client approval.
5. Project Duration
5.1 Estimated completion dates are provided in good faith and are subject to weather conditions, material availability, labour availability, and unforeseen circumstances.
5.2 The Contractor shall not be liable for delays beyond its reasonable control.
6. Access to Site
6.1 The Client shall provide reasonable access to the site during normal working hours.
6.2 The Client shall ensure that all required permissions, approvals, and access rights are obtained before work commences.
7. Additional Work and Variations
7.1 Any variation requested by the Client must be approved in writing.
7.2 Additional work may result in revised pricing and project timelines.
7.3 Verbal instructions shall not be binding unless confirmed in writing.
8. Existing Structures
8.1 While every reasonable care will be taken, the Contractor shall not be liable for hidden defects, concealed plumbing, electrical wiring, structural weaknesses, asbestos, or other unforeseen conditions discovered during the project.
8.2 Any remedial work arising from such conditions shall be quoted separately.
9. Health and Safety
9.1 The Contractor shall take reasonable steps to maintain a safe working environment.
9.2 The Client shall keep children, pets, and unauthorized persons away from the work area.
10. Warranty
10.1 Workmanship is warranted for a period of 12 months from practical completion, subject to normal wear and tear.
10.2 Manufacturer warranties on materials and products supplied shall be passed on to the Client where applicable.
10.3 The warranty does not cover damage caused by misuse, neglect, alterations by third parties, natural disasters, or lack of maintenance.
11. Ownership
11.1 Ownership of materials supplied remains with the Contractor until full payment has been received.
11.2 The Contractor reserves the right to remove unpaid materials where legally permissible.
12. Cancellation
12.1 If the Client cancels the project after acceptance, the Client shall be liable for all work completed, materials purchased, and any reasonable cancellation costs incurred.
12.2 Deposits are non-refundable once materials have been ordered or work has commenced.
13. Limitation of Liability
13.1 The Contractor’s liability shall be limited to the value of the contract.
13.2 The Contractor shall not be liable for indirect, consequential, or special damages arising from the project.
14. Dispute Resolution
14.1 The parties shall attempt to resolve disputes amicably through negotiation.
14.2 Failing resolution, disputes shall be referred to mediation before legal proceedings are instituted.
14.3 These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
15. Practical Completion
15.1 Practical completion shall occur when the work is substantially complete and fit for its intended purpose.
15.2 Minor defects or snag items shall not prevent practical completion and final payment.
